Duties Imposed on Brazilian Imports of French and Korean Nitrile Rubber

On August 13, 2018, the Brazilian Government decided to impose a definitive anti-dumping measure to imports of nitrile rubber (NBR), originating in South Korea and France. The duties are valid for 5 years.
 
Note: Duties do not apply to liquid and powdered nitrile rubbers produced by the spray drying process with a particle size less than or equal to 0.16 mm.

Since the final anti-dumping duties imposed to Korean companies are lower than the provisional duties applied during the investigation, it is possible for importers to request the refund of the amounts paid in excess for imports made between 23/11/2017 and 08/13/2018. Compensation only applies to South Korea, since the duties for French companies were higher than those applied preliminarily during the investigation.
 
It is important to emphasize that the companies which participated in the investigation procedure (LG Chem and Arlanxeo) were the ones that received the lowest duties imposed, reinforcing the importance of the participation of exporters in these types of procedures.
 
LG Chem has participated in other antidumping proceedings in Brazil in the past, which has given the company the experience necessary to achieve good final results.
